These Terms of Service (“Terms”) govern fortifyfinish.com and purchases from Fortify Finish, operating as Fortify Surface Science (“Fortify,” “we,” “us,” or “our”). Please read them together with our Privacy Policy and the written warranty applicable to the product purchased.
1. ACCEPTANCE AND BUSINESS ACCOUNTS
You agree to these Terms by completing an acceptance step when they are presented with an account, checkout, or written order. If you do not agree, do not complete that transaction. You must be at least 18 and, when acting for a business, authorized to bind that business.
Provide accurate account, billing, and order information. Protect your account credentials and notify Fortify promptly of suspected unauthorized use.
2. PROFESSIONAL USE AND PARTNER APPROVAL
Fortify coatings are intended for professional application. Purchases by painting companies, dealers, or franchise operators are subject to any required Fortify approval and applicable separate agreement. Submitting an application, opening an account, or purchasing products does not itself grant a franchise, exclusive territory, distribution rights, trademark license, or authority to bind Fortify.
Independent applicators are responsible for their own workmanship, project contracts, safety, insurance, and required permits unless Fortify expressly agrees otherwise in writing.
3. APPLICATION AND TECHNICAL INFORMATION
Follow the current product label, Technical Data Sheet, Safety Data Sheet, and written instructions for approved surfaces, preparation, application conditions, film thickness, and curing. Ask Fortify before using a product outside its published specifications.
Performance, coverage, and drying times vary with the substrate and conditions. Laboratory results and marketing examples do not guarantee identical results in every installation. On-screen and printed colors are approximate; approve a physical sample or test area before full application. Application-related warranty exclusions apply only as provided in the applicable written warranty and law.
4. ORDERS, PRICING, AND PAYMENT
Prices are in U.S. dollars. Taxes, shipping, and other applicable charges must be disclosed in the quote or checkout. Price changes apply to future orders and do not change an accepted order without agreement or a lawful basis.
Orders require Fortify’s acceptance. An automated submission receipt alone is not acceptance unless expressly stated. Before acceptance, we may decline an order for unavailability, pricing or description errors, or suspected unauthorized or unlawful activity. If we decline an order after payment, we will promptly refund the amount collected.
Payment is due at purchase unless Fortify agrees to different terms in writing. Use a payment method you are authorized to use.
5. SHIPPING AND DELIVERY
Shipping charges and estimated timeframes are disclosed with the order. Delivery dates are estimates unless Fortify expressly guarantees a date. Provide a complete, accurate delivery address. Weather, carrier issues, and other events outside reasonable control may affect delivery; they do not remove rights provided by law.
If we cannot ship within the promised or legally required period, we will notify you and provide any required choice to accept a delay or cancel for a prompt refund of unshipped merchandise. Inspect deliveries and report shipping damage promptly.
6. RETURNS, CANCELLATIONS, AND PRODUCT CLAIMS
Contact jamie@fortifyfinish.com before returning products or requesting cancellation. Voluntary returns of unopened, unused, nondefective stock products require prior written authorization. Opened, used, custom-tinted, or specially manufactured products are not eligible for voluntary returns unless Fortify agrees otherwise in writing.
Any return window, restocking fee, or allocation of return freight must be disclosed before purchase. Authorized returns follow those agreed conditions. Promptly report incorrect, damaged, or allegedly defective products, with the order number, available lot information, and photos.
These voluntary-return conditions do not limit applicable written warranties, remedies for defective goods, or mandatory refund rights. If Fortify cancels an unshipped order, we will refund amounts paid for cancelled items and related charges not incurred. Approved refunds go to the original payment method unless law requires otherwise.
7. PRODUCT WARRANTIES
Fortify product warranties, including any 20-year limited product warranty, are governed by the applicable written warranty supplied or made available before purchase. That document defines eligible products, coverage, duration, conditions, exclusions, claim procedures, and remedies. Request the complete warranty if only an overview is displayed.
Warranty summaries do not replace the complete written warranty. Review that warranty for any labor, removal, or reapplication coverage. These Terms do not reduce remedies expressly promised in the applicable written warranty or exclude implied warranties and other rights where the law does not permit that exclusion.
8. WEBSITE USE AND INTELLECTUAL PROPERTY
Website content, logos, images, graphics, and documents belong to Fortify or its licensors. You may view, download, and print published product, safety, and warranty documents for legitimate internal business and project use. Other reproduction, alteration, distribution, or use of Fortify branding requires written permission or an applicable license.
Do not misuse the website, attempt unauthorized access, submit fraudulent information, interfere with operations, or violate law. Third-party websites and services have their own terms; Fortify does not control their content or operations.
9. LIMITATIONS OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, and except for remedies expressly provided in an applicable written warranty, Fortify and its personnel are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, business interruption, or loss of use, arising from the website or a purchase.
Subject to the same exceptions, Fortify’s aggregate liability arising from an order is limited to the amount paid for the affected products or services. These limits do not apply to fraud, willful misconduct, gross negligence, personal injury, or liability that cannot lawfully be limited. This section does not reduce Fortify’s express written warranty obligations or rights and remedies that cannot legally be excluded.
10. GOVERNING LAW AND DISPUTES
Unless an applicable signed agreement provides otherwise, these Terms are governed by Indiana law, without regard to conflict-of-law rules. Subject to mandatory legal protections, disputes will be heard in state or federal courts in Indiana having proper jurisdiction.
Please contact Fortify first so we can try to resolve concerns. This request does not prevent you from exercising legal rights or extend applicable claim deadlines.
11. SEPARATE AGREEMENTS AND UPDATES
An applicable signed partner, distributor, or other commercial agreement controls conflicting commercial terms. The applicable written product warranty controls conflicting warranty terms.
We may revise these Terms by posting an updated version and providing additional notice where required by law. Changes apply prospectively; an accepted order remains governed by the version accepted unless the parties agree otherwise. If a provision is unenforceable, the remaining provisions continue to the extent allowed by law. Failure to enforce a term does not waive future enforcement.
